Wisconsin Supreme Court: Elizabeth Bothfeld v. Wisconsin Elections Commission

On September 16, 2026, the Wisconsin Supreme Court will hear oral arguments on Elizabeth Bothfeld v. Wisconsin Elections Commission. Case Number 2026AP1168. This is a review of a decision by a three-judge panel, appointed by the Wisconsin Supreme Court pursuant to WIS. STAT. § 751.035, which dismissed plaintiffs’ action seeking to declare the congressional map adopted by the Wisconsin Supreme Court in 2022 unconstitutional on the grounds that it violated the separation of powers doctrine and sections 1, 3, 4, and 22 of Article I of the Wisconsin Constitution.
